Terms of Service

1. Acceptance of Terms
This Terms of Service ("Agreement") is a legally binding contract between you ("User", "you") and PixelTruth AI Intelligence ("Company", "we", "us"). By downloading, installing, accessing or using the PixelTruth.APP mobile application or any related services, you confirm that you have read, understood and agreed to be bound by this Agreement and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these terms, do not install or use the application.
2. Eligibility
To use PixelTruth.APP you must:
- Be at least 16 years of age (or 13 in the United States under COPPA)
- Have the legal capacity to enter into a binding contract in your jurisdiction
- Not be prohibited from using the service under applicable law
- Have a valid Google account and comply with Google Play's Terms of Service
If you are accessing the service on behalf of an organisation, you represent that you have the authority to bind that organisation to this Agreement.
3. Account Registration and Security
The application may be used in guest mode (without registration) or with a registered account. If you create an account:
- You must provide accurate, current and complete registration information
- You are solely responsible for maintaining the confidentiality of your credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately at contact@pixeltruth.app if you suspect unauthorised access
- You may not share, transfer or sell your account to any third party
We reserve the right to suspend or terminate accounts that contain false information or that are used in violation of this Agreement.
4. Description of Service
PixelTruth.APP is an AI-powered mobile application designed to analyse photographic images for signs of artificial generation or digital manipulation. The service examines visual patterns, statistical image features, EXIF metadata and digital signatures to provide probabilistic assessments of image origin.
The service is capable of identifying content generated by, or manipulated using, tools including but not limited to: DALL-E 3, Midjourney, Stable Diffusion, Adobe Firefly, Flux, Gemini Imagen, ChatGPT image generation, and images edited in Photoshop, Lightroom or similar software. Detection capabilities may vary depending on the subscription plan.
All results are probabilistic estimates, not definitive conclusions. See Section 12 for the full accuracy disclaimer.
5. Subscription Plans
PixelTruth offers the following service tiers:

Scan limits reset daily at midnight UTC. Unused scans do not carry over. We reserve the right to modify plan features or limits upon 30 days' notice.
6. Billing and Automatic Renewal
Paid subscriptions are processed exclusively through the Google Play Store. By purchasing a subscription you authorise Google Play to charge your payment method on a recurring monthly basis until you cancel.

Payment processors may retain the card type and last 4 digits of your card number solely for billing identification purposes. All payment data is governed by the respective processor's privacy policy. |
| Failed payment | If Google Play is unable to charge your payment method, your subscription will be downgraded to the Free plan until payment is resolved. |
7. Refunds and Cancellation

8. User Obligations
By using the service you represent and warrant that:
- All information you provide is truthful, accurate and up to date
- You have the legal right to submit the images you select for analysis
- Your use of the service complies with all applicable laws, including privacy, intellectual property and data protection laws
- You will not use analysis results to harass, defame, or make unfounded accusations against any individual or organisation
- You understand that analysis results are probabilistic and you will apply independent judgement before acting on them
9. Prohibited Conduct
The following actions are strictly prohibited and may result in immediate account termination and legal action:

| Account abuse | Creating multiple accounts to circumvent scan limits, sharing account credentials, or attempting to access accounts belonging to others. |
| Security attacks | Attempting to breach, overload or interfere with our infrastructure, including DDoS attacks, credential stuffing or network scanning. |
| Misuse of results | Using analysis results to harass, defame, extort or cause harm to individuals or organisations, or presenting results as definitive legal evidence. |
| Intellectual property | Reproducing, copying, distributing or commercially exploiting any part of the service, its interface or outputs without written permission. |
10. Intellectual Property Rights
All elements of the PixelTruth service — including the application, AI detection models, analysis algorithms, UI/UX design, brand assets, trademarks and documentation — are the exclusive property of PixelTruth AI Intelligence and are protected by international copyright, trademark and patent law.
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the application solely for your personal, non-commercial purposes. No other rights are granted.
You retain full ownership of all images you select for analysis. Your image files never leave your device — only technical feature data derived from the image is processed by our service, as described in the Privacy Policy.
11. Analysis Accuracy Disclaimer
PixelTruth uses advanced multi-engine image analysis to provide probabilistic assessments of image origin. By using the service you acknowledge and accept the following:
- Results are statistical estimates — not definitive proof of authenticity or manipulation
- AI detection technology is not infallible. False positives and false negatives can occur
- The rapid evolution of generative AI means that newly released models may not yet be detectable
- Results must not be used as the sole basis for any legal proceeding, editorial publication, employment decision or accusation against any person
- PixelTruth assumes no liability for decisions made based on analysis results
12. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
We do not warrant that: (a) the service will be uninterrupted or error-free; (b) analysis results will be accurate, complete or reliable; (c) the service will be free of viruses or other harmful components; or (d) any defects will be corrected.
Some jurisdictions do not allow the exclusion of implied warranties. In such cases, the above exclusions apply to the fullest extent permitted by law.
13. Limitation of Liability
To the maximum extent permitted by applicable law, PixelTruth AI Intelligence and its officers, directors, employees and agents shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages — including but not limited to loss of profits, revenue, data, goodwill or reputation — arising from or in connection with your use of the service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising under or in connection with this Agreement shall not exceed the greater of: (a) the total fees paid by you to us in the 12 months preceding the claim; or (b) EUR 100.
Nothing in this Agreement limits liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
14. Indemnification
You agree to indemnify, defend and hold harmless PixelTruth AI Intelligence and its officers, directors, employees, contractors and agents from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the service; (b) your violation of this Agreement; (c) your violation of any third-party rights; or (d) any content you submit for analysis.
15. Suspension and Termination
By you — you may stop using the service at any time. To delete your account and all associated data, use the account deletion option in the app settings or contact us at contact@pixeltruth.app.
By us — we reserve the right to suspend or terminate your account at our sole discretion, with or without notice, if: (a) you violate any provision of this Agreement; (b) we are required to do so by law; (c) we discontinue the service; or (d) continued access poses a risk to the security or integrity of the platform.
Effect of termination — upon termination, your licence to use the application is immediately revoked. Provisions that by their nature should survive termination (including Sections 10, 11, 12, 13, 14, 16) shall survive.
16. Governing Law and Dispute Resolution
This Agreement is governed by and construed in accordance with the laws of the European Union and the jurisdiction in which PixelTruth AI Intelligence is registered, without regard to conflict of law principles.
Informal resolution — before initiating any formal proceedings, you agree to contact us at contact@pixeltruth.app and attempt to resolve the dispute informally for a period of 30 days.
Formal proceedings — if informal resolution fails, disputes shall be submitted to the exclusive jurisdiction of the competent courts of the jurisdiction where the Company is registered. Nothing in this clause prevents either party from seeking urgent injunctive relief in any competent court.
Class action waiver — to the extent permitted by applicable law, you agree that any dispute will be resolved on an individual basis and not as part of a class, consolidated or representative action.
17. Changes to These Terms
We may update these Terms of Service from time to time. When we make material changes, we will notify you by: (a) in-app notification; (b) email to your registered address; or (c) a prominent notice on our website — at least 14 days before the changes take effect.
Your continued use of the service after the effective date of the updated terms constitutes your acceptance of the changes. If you do not agree to the updated terms, you must stop using the service and cancel any active subscription before the effective date.
